Mrs H from Essex instructed Rowan Rose Solicitors to make a claim for mis-sold Solar Panels on her behalf and we settled the matter in only 9 days.
Her claim was brought under Sections 56 and 75 of the Consumer Credit Act 1974 against Barclays. It was held that as the finance provider, Barclays, were jointly and severally liable for the reimbursement of payments made in respect of the Solar Panel System. The supplier of the system was Smart Save Solutions, who are no longer trading, and they made representations regarding the system at the point it was sold. For example, Mrs H was told that “the system will not cost you anything and it will provide you with a substantial income over the life of the system” (generally 25 years).
Mrs H relied upon the representations made by the supplier and entered into a finance agreement with Barclays on or around the 4th November 2014 to provide funds for the purchase and installation of Solar Panels at her home. The price of the system was £6,700.00 with the total cost of the loan coming to £10,542.00
Rowan Rose Solicitors successfully argued that the Solar Panels were not fit for purpose and that our client was misled into purchasing the system due to her reliance on the statements made by the sales representative of the supplier which were false.
Due to our expertise and experience in bringing these types of actions, Rowan Rose Solicitors was able to settle this claim for over £4,000.00 in only 9 days.
