Williams and Waistell v Network Rail
Mr Williams and Mr Waistell owned two adjoining bungalows. Behind their properties there was an embankment which had a large strand of Japanese Knotweed present for at least 50 years. The land was owned by Network Rail. Japanese Knotweed had been found to have spread from Network Rail owned land onto the Claimants’ properties. The Court decided that Network Rail should pay £4320.00 for the removal of the Japanese Knotweed, £350.00 per year for inconvenience/loss of enjoyment and also pay £10,000 for the perceived reduction in the value of their properties.
